A state High Court sitting in Abeokuta, Ogun State on Monday passed the death sentence on a 36-year-old man, Jelili Agemo to death for armed robbery and unlawful possession of fire arms.

Agemo was charged with conspiracy, armed robbery and unlawful possession of firearms and was given the death sentence.

The prosecution counsel, Mrs Olajumoke Ogunbode, told the court that the convict committed the offence on October 10 and 14, 2009 at Majekembo Street, off quarry road in Abeokuta.

Ogunbode said the convict conspired with others, now at large, and dispossessed six persons of their valuables, including phones, laptops, jewelries and money.

When the convict was arrested, he was found with three guns and 18 cartridges with no license, the counsel said.

Ogunbode said the offence contravened sections 16(b) and 1(2)a of the Robbery and Firearms (special provisions) Act, Cap ROI, Laws of the Federation of Nigeria 2004.

In his judgment, Justice Abiodun Akinyemi said the court was convinced beyond reasonable doubt that the convict was guilty as charged.

Akinyemi held that the evidence presented by the prosecution was tenable.

He therefore sentenced the convict to a death sentence by hanging for armed robbery and 10 years imprisonment for unlawful possession of firearms.

Akinyemi said the 10 years punishment will run concurrently.
